Using market forces to shift the distribution and use of western water resources is a controversial topic. Some individuals fear that private investments in western agriculture will doom the sector, as water will inevitably flow to higher-paying uses and users in urban settings. To others, these investments allow agriculture to become more efficient and resilient, and when done correctly, can minimize any pain associated with large-scale water reallocations.

James Eklund

As director of the Colorado Water Conservation Board, James was the architect of Colorado’s first strategic water plan and is regularly consulted in implementing what has become the “gold standard” of water plans in the Western U.S. During his tenure as director, he quickly built a reputation as a leader in negotiation and diplomacy – bringing together multiple stakeholders with opposing goals in order to collaboratively craft binding solutions to common problems. As Colorado’s representative on the Colorado River, James negotiated the Drought Contingency Plan with the six other Basin States, the US government, and the Republic of Mexico. He is a fifth generation Coloradan from the Western Slope where his family run cattle operations on a tributary to the Colorado River. James teaches on water and food sustainability at the University of Denver.

Colorado River Water Conservation District

Peter Fleming, Esq., is general counsel for the Colorado River Water Conservation District, a position he has held since 2002.  In addition, Peter currently serves on the Upper Colorado River Commission’s Legal Committee.  Peter frequently speaks on water, interstate compact and governmental issues.  Peter previously was a member of Carlson, Hammond & Paddock, L.L.C. in Denver, where his practice focused on water rights, real property, environmental, real estate, and governmental matters.  B.A., St. Lawrence University, 1986; J.D., University of Colorado, 1991.

Doug Kenney is director of the Western Water Policy Program within the University of Colorado Law School in the Getches-Wilkinson Center for Natural Resources, Energy and the Environment. He is also founder and current chair of the Colorado River Research Group. He has written extensively on several water-related issues, including law and policy reform, river basin and watershed-level planning, climate change adaptation, and water resource economics. Dr. Kenney has served as a consultant to a variety of local, state, multi-state, and federal agencies, including several Interior Department agencies, EPA, and the US Forest Service; and national governments and NGOs in Asia and Africa. Additionally, he has made presentations in 21 states (and the District of Columbia), 8 nations, and 5 continents. He has a B.A. in biology from the University of Colorado, a M.S. in Natural Resources Policy and Administration from the University of Michigan, and a Ph.D. in Renewable Natural Resource Studies from the University of Arizona.
